Terms of Service
1. Acceptance
By accessing or using PetalCanvas ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. The Service
PetalCanvas provides the software service described at app.petalcanvas.com. We reserve the right to modify or discontinue the Service, in whole or in part, at any time, with reasonable notice where practicable.
3. Accounts
To use the Service you must register for an account and provide accurate information. You are responsible for maintaining the security of your account credentials and for all activities under your account. Notify us immediately at hello@petalcanvas.com of any unauthorised access.
4. Acceptable use
You agree not to use the Service to: (a) violate any applicable law; (b) infringe the rights of others; (c) interfere with the integrity or performance of the Service; (d) attempt to gain unauthorised access to the Service or its related systems; or (e) transmit malware or other harmful code.
5. Fees and payment
If you subscribe to a paid plan, you agree to pay all applicable fees on the schedule indicated. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice; changes apply to renewal periods only.
6. Termination
You may cancel your account at any time from within the Service. We may suspend or terminate your access if you materially breach these Terms, with notice where practicable. Upon termination, your right to use the Service ceases; data export options remain available for 30 days post-termination.
7. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, except as required by applicable law. To the maximum extent permitted by law, we disclaim all such warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, neither PetalCanvas nor its directors, employees, or agents will be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Service.
9. Governing law
These Terms are governed by the laws of South Australia, Australia, without regard to its conflict of law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.
10. Changes to these Terms
We may revise these Terms from time to time. We will notify users of material changes via email or in-product notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
